What Happens To My Will If I Divorce
The legal act of divorce cancels any benefit under a Will to a former spouse or civil partner, unless the wording clearly states that divorce or dissolution should not effect the entitlement.
The appointment of a spouse or civil partner as an Executor is cancelled by subsequent divorce or dissolution.
In general, it is advisable to make a new Will on marriage, civil partnership, divorce or dissolution.
I Am Divorced Already And Want To Write A Will
If you are currently Divorced and want to write a Will then that is fine. We often write Wills that take into account children from previous relationship in this instance. We can be totally discreet on this matter if you not want the new partner to know. Also should the children be minors and you do not want your ex-partner to be involved with the any of the finances, we can protect the money via a trust so that it is only used in for the direct interests of the child.
